Estate Liquidation Agreements

Below are a few of our basic contract agreements.

* A complete contract will be available for any prospective client at time of on-site estimates.

COMMISION: As remuneration for our services, One-Eyed Jacks ("OEJ") will retain a commission from the Seller on the final sale of all merchandise included in the estate sale. OEJ shall incur all normal expenses of the sale, including advertisement and labor for set up of the sale. Labor fees for clean out before and/or after the sale are separate and are listed below.

Our commissions are generally 35%, but may vary depending on the quality and quantity of the items or the estate.

CLEAN OUT FEES: Additional fees may be charged for cleanout before and/or after the sale, which include:

  • OEJ Labor: $120/hour for 3 OEJ employees ($40/hour for one)
  • Independent Laborers: $__ per hour, as needed
  • Truck rental fees
  • Fuel expenses
  • Dump charges

METHOD OF SALE:

(a) Time, Place and Items. The time, place and items to be sold shall be determined and agreed upon by Seller and OEJ.

(b) Method of Payment. During the Sale, we accept cash, checks (with proper ID), Venmo & Square approved credit cards on all sales. At the sale, all items are to be paid for by (a) cash, (b) cashier's check, (c) personal check with approved credit, or (d) approved credit cards. Any and all checks or credit card sales accepted by OEJ shall be fully covered by OEJ.

(c) Completion of Sale. No sale shall be considered complete until Seller has made final and full payment to OEJ in cash, credit card, cashier's check, or in the event that payment is made by approved personal check, after such check has cleared.

(d) Inappropriate Property. If OEJ deems any property inappropriate for public sale at any sale location operated by OEJ, OEJ may, with Seller's agreement, sell it privately or consign it to any other sale location or dealer. OEJ will be responsible to Seller for the exercise of reasonable care in disposition of such property, and Seller will be liable to OEJ for commission and other expenses in accordance with the terms of this Agreement.

REPAIRS: If, in the judgment of OEJ (and with prior agreement of Seller), the value of any item of property may be significantly enhanced (by framing, cleaning, cabinet repairs, refinishing, touching-up, porcelain repairs or any other minor repairs), OEJ may have such work performed and charged to Seller.

OEJ'S RIGHT TO WITHDRAW PROPERTY FROM SALE: OEJ shall reserve the right to withdraw any property at any time before the sale if, in the judgment of OEJ:

  • There is doubt as to its attribution or authenticity;
  • Seller's representations to OEJ concerning the property are inaccurate in any respect;
  • Seller has breached, or is about to breach, any provision of this Agreement; or
  • For other good reason.

ESTIMATES AND DESCRIPTION: Any appraisal, estimate or other statement by any OEJ representative with respect to the selling price or description of any property is a statement of opinion only. OEJ makes no warranty to Seller with respect to the selling price or description of the property and shall not be responsible to Seller for any errors or omissions in describing the property.

OEJ shall have complete discretion as to the description of the property in advertisements or other literature. OEJ may, at the discretion of OEJ, and with Seller's agreement, engage the services of one or more outside experts to authenticate the property and charge Seller the fees of such expert.

No description or information provided by any such expert, whether or not included in OEJ advertisements or other literature, constitute a representation or warranty made by OEJ to Seller with respect to the property consigned or its value.

Notwithstanding any information, valuation or description obtained from an expert or included in our advertisements or other literature, OEJ and Buyer are entitled to rely upon any representation or warranty made by Seller.
